Covenant Clarifications

The Board really appreciates everyone making the time to familiarize themselves with the Community Covenants. The original covenants are an older document and can easily feel overwhelming and difficult to read. We strongly encourage property/homeowners to read the Procedures, Rules, & Standards along with the Architectural Standards as these documents have been revised 2005/2012 and are very easy to understand and cover the majority of covenants and certainly the most common of violations.

*****VIOLATION CLARIFICATION*****

Trees, Shrubbery, and Vines must be: Contained, Maintained and Controlled

Contained: cannot bleed over onto the sidewalk or anywhere that would impede public use.
Maintained: must be trimmed, weeded, and pruned on a regular basis to maintain esthetic shape and healthy growth.
Controlled: must not impede entrances, windows, walkways, or roofs.
 

Lawn Care: at least 75 percent of the lawn must be weed free with no groupings of weeds greater than a 12in square and controlled via a lawn service or personal homeowner care to avoid an unkempt notice. A weed is considered any growth in competition with the grass. Lawn must be trimmed and mowed on a regular basis to avoid a height greater than 10in.
 

Flower Beds/Landscaped areas: mulch or decorative stones are recommended. Areas must be weeded and trimmed on a regular basis to avoid unkempt conditions. Garden flags, Figurines, Fountains and Sculptures must be approved by the Architectural Committee/Board.
 

Basketball Hoops: Must be approved by the Architectural Standard Committee/Board of Directors. Mobile Hoops are strongly encouraged due to their ability to be moved out of site per Architectural Standards and ease of maintenance as all Basketball Hoops must be kept in Like New condition.
 

Mailbox Maintenance:

  • Metal or Iron Boxes: must be painted Black Matte/or Glossy
  • Brick: Power washed
  • Wood: needs to stained with Behr Solid Color Stain Tugboat SC-141 (Home Depot) or match house trim color or be black.

  • Mailboxes must be solidly supported, and numbers must be clearly visible for UPS.

    Fences: Existing fences need to be in good repair, no rotting boards, and stained with Solid or Semi-Transparent house and fence wood stain Tugboat SC-141 or TC-141. All new fencing must be approved by the Board and adhere to provisions laid out in the Architectural Standards.
     

    Other Common Violations
    Street Parking, Trailers and Boats, Non-attached unapproved Sheds, Exposed Garbage Cans, Dogs, and Visible Stored Vehicles.
     

    Fine Process for Courtesy Notices

    1st Courtesy Notice: 1st Courtesy Notice: Requires you take care of your violation(s) within 10 days. If this is not possible you must contact Manager@mtnbrookofmadison.com to inform us of your plan of action and the date you are proposing for completion.
    2nd Courtesy Notice: Requires you take care of violation(s)within 10 days. If a plan of action has not been established a fine will be imposed for $50.00 and $5.00 per day thereafter effective from date of notice.
    3rd Courtesy Notice: Fine imposed immediately for $50.00 and $5.00 per day thereafter. You may request a hearing within 10 days from the date of the notice regarding the fine. Any statements, evidence, and witnesses may be produced by you at the hearing; all rights to have the fine reconsidered are waived if a hearing is not requested within 10 days of the date of notice.
    Continuation: Fines continue if Violation(s) are not taken care of. The Board reserves the right to resolve the situation. Homeowner will be responsible for all associated costs of the resolution. Liens and legal injunctions may be imposed without further notice.
